Well, it's a little bit of a long story so here goes. When I had contacted YAMAHA for the copyright permissions, they emailed back with info, I forwarded that to the patch makers, and then a few days later they sent updated images of the patch with the logos and such, so I "thought" they had received the permissions directly from Yamaha, so I approved the design to go into Pre-Production for the SEWOUT test!
THEN I get an email from YAMAHA stating that they had approved the permissions....WITH A MODIFICATION to the patch, see image below:
They wanted the Tuning Forks image AND YAMAHA LOGO all together like they currently use it! WHAT COULD I SAY!?
I forwarded that EMAIL to the patchmakers because they stated that extra $$ would be incurred if a CHANGE was made AFTER the SEWOUT phase!! HOWEVER, it wasn't MY FAULT that they proceeded with the process BEFORE RECEIVING the actual copyright permissions!?
I then received the 3 copies of the CONTRACT for the Permissions from YAMAHA that I had to sign and return to them, that was over a week ago. They are a bit SLOW at YAMAHA, still waiting for my signed copy of the contract to be sent back to me,and to be forwarded to the patchmakers, and THEN the patches can be made, albeit with the above YAMAHA CORP. required change!!!
That's where the process is right now, mayby by Xmas!?

It still looks GREAT and I don't have any issue with Yamaha wanting the recognition. After all .. they used to and perhaps still do say "when you know how their built" and this bike was built very well.

A little anyways...I think Yamaha's stipulation to use their logo is a thumbs up in approving of this patch being made.I've always liked the tuning fork logo and nvr thought I could see one a patch from this site!Thanks TC for staying with it...it would appear to be well worth the effort. Another Update, but not the one you all are wanting!

Well, thanks to the Yamaha Corporate Beauracracy, they somehow LOST the original contracts I had signed and sent to them a few weeks ago! So, they sent me another copy via Email, I printed it in Triplicate, and signed them, and sent them back to YAMAHA. They didn't loose that set, and finally got them signed, and sent back to me just last week. I've just sent it to the patchmakers, and will be contacting them by Email to see what the damages will be for the "MIX UP" in communication that previously occurred that caused it to get to the SEWOUT phase before they had the actual copyright permissions!?
BTW, Yamaha made yet another change in the design, changing the location they wanted the LOGO to be, which actually works better...IMHO!? Below is a copy of the CONTRACT I had to sign, agree to....in the fine print you'll see where NO PROFIT can be made from this, so....I can only charge the actual production and shipping charges, non extra for the XS11.com site!?
But like Xilierating said, it will have YAMAHA's stamp of approval, which will actually make it an OFFICIAL YAMAHA PATCH! They also requested that I SEND THEM a patch for their records! This will be a LIMITED EDITION RUN of only 100 patches. And in all fairness to all the Xsives that will want to get one, I "think" I'll request that folks first only ORDER 1 patch per member, albeit a few households have more than 1 member in their home ie. John and Wildkat, but that not requesting more for children or not active SWMBO's might be a FAIR request so that as many separate Xsives will be able to get a piece of HISTORY!?
Please do NOT send me any requests either as replies to this thread or in a PM, as I do not have them in my hands YET! Once I actually have them available, I'll post the ordering info, and then it'll be a First come/first paid/first served process. IF I have any left over after the initial month's offering, then I can see about duplicates to members that already have one!

LIMITED TRADEMARK LICENSE AGREEMENT
This Agreement is made this ____ day of November, 2008, by and between Yamaha Motor Corporation, U.S.A., with its principal place of business at 6555 Katella Avenue, Cypress, California 90630(hereinafter referred to as “YMUS”) and Tyrone Curtis Gresham, an individual, residing at "Editted Street Addy", Portsmouth, Virginia 23703 (hereinafter referred to as “Licensee”).
1. Licensee has requested that YMUS issue a limited license to Licensee for the trademarks listed in Section 2 of this Agreement (hereinafter the “Trademarks”) on the products listed in Section 3 of this Agreement (hereinafter the “Products”). Licensee agrees that Licensee shall distribute the Products bearing the Trademarks only to members of Licensee’s group, and shall not distribute the Products bearing the Trademarks for any
commercial purpose. Licensee may charge members of Licensee’s group for the actual cost of manufacture and handling for the Products, but may not charge in such members for the Products in excess of these costs.
2. The Trademarks that Licensee shall have the right to use under this Agreement shall be:
XS1100 motorcycle image and name, Yamaha logo
3. The Products that Licensee shall have to use the Trademarks on under this Agreement
shall be:
100 patches commemorating the 30th anniversary of the 1978 XS1100 motorcycle
4. Prior to the actual production of the Products, Licensee shall show the proposed utilization of the Trademarks on the Products to YMUS for YMUS’s review and written approval. All use of the Trademarks shall be in compliance with YMUS’s identification requirements, and the proposed utilization of the Trademarks shall be subject to YMUS’s approval in YMUS’s sole discretion.
5. YMUS hereby grants the license as requested by Licensee for the Trademarks and the Products as set forth herein under the terms and conditions of this Agreement. Licensee has no rights in the Trademarks except as set forth herein, and may not sublicense the Trademarks or use them in any way not permitted in this Agreement.
6. This Agreement shall expire one year from the date of execution by both parties of this Agreement. After the expiration of this Agreement, Licensee shall be permitted to continue to utilize the Trademarks on Products produced prior to the expiration of this Agreement that were produced in compliance with this Agreement. This Agreement may be renewed by the parties for successive one year terms, provided that such renewal is in
a writing signed by both parties and is on the same terms and conditions as this Agreement.
7. Licensee agrees that it is not the agent of YMUS and shall in no way represent in any way that it is the agent of YMUS. Licensee shall conduct its business in such a way as to clearly indicate that it is not the agent or representative of YMUS. Licensee shall indemnify and hold YMUS harmless from any cost and liability caused by the acts of Licensee, its employees or agents and from any liability caused by any unauthorized act by Licensee, its agents or employees.
8. This Agreement may not be assigned by Licensee in whole or in part without the prior written consent of YMUS.
9. This Agreement supersedes any and all other agreements, either oral or in writing, between the parties hereto with respect to the subject matter hereof and contains all of the covenants and agreements between the parties with respect to said matter. Each party to this Agreement acknowledges that no representations, inducements, promises or
agreements, orally or otherwise have been made by any party which are not embodied herein, and that no other agreement, statement or promise not contained in this Agreement shall be valid or binding. This Agreement may not be altered, amended or modified except by written instrument signed by the parties hereto.
10. In the event that there is a dispute between the parties as to this Agreement or any obligation under this Agreement the parties hereto shall discuss such matter in good faith and attempt to resolve this matter prior to the initiation of any legal proceeding. In the event that such discussions do not resolve the dispute between the parties Licensee agrees to personal jurisdiction in California.
11. Licensee agrees should Licensee violate this Agreement that YMUS will suffer irreparable harm from Licensee’s actions. As a result Licensee agrees that in addition to monetary damages, if any, YMUS shall be entitled to any form of equitable and/or injunctive relief should Licensee violate the terms of this Agreement.
