  • Ebay Seller Fraud on a member

Sold my XJ11 and XS11 Standard then bought a doggey XS850 triple with a bad wire harness in early August.

This is a case of outright fraud and deceptive sales practices by listing an item using a misleading description; making false statements.

Asked an Ebay re-cycle seller in North Dakota if he had any cutting issues with his wire harness [a direct email question]
he replied; "All known issues are always disclosed" = a bald-faced lie.

Ebay was absolutely no help 'cause the seller with-held an Invoice and lied to them saying he hadn't been paid. I paid with previously & mutually AGREED upon Western Union Money Order; I have my receipt for the exact amount made out to this seller. He just shelved the MO then waited until after the case had been decided in his favor via Ebay's default stupidity.

Early Sept. I complained Not-As-Described - he then agreed to a full refund if I would send the part back.

Three weeks later: "Not my part" he claims (its the Exact same ----- part!).
Have plenty of pics of his harness and my bike with non-functional one still aboard.
I also have pics of his crappy, hacked up harness sitting on my kitchen floor - an exact match to the ebay listing pics.

Ebay tossed out my claim simply because it wasn't paid via PayPal.
Seller gets to keep entire sum, I got nothing but a hard time and a really bad experience.

The capper is this Seller had the gall to imply I was using extortion against him IN WRITING well before I'd even sent the part back and before he'd seen HIS part, in the same box, in the same package.
All of this because I asked for a full refund.
He even called me screaming and yelling because I dared to give him richly deserved negative feedback. Nice.

    Seems as if someone else had already pulled a mine-for-yours switch on him in the past (speculation) and he was looking for a way out. When I called him at his business Aug. 31st. he was full of lame excuses;

Me: "Don't you check your parts BEFORE you sent this kind of junk out?"
Iron_Stallion "Well they're all that way." on and on ...

Seller is Iron_Stallion and my case is pending against him and against Ebay in California and North Dakota via their States Attorneys for FRAUD.

    Beware of this seller.

My Feedback rating on Ebay is 100% for SIX years.

    crooked ***holes

Ebay is not what it used to be. About 9 years ago, I had an issue with a seller, and ebay fought tooth and nail to get me a refund, and I got it. A bit over 2 years ago, I got screwed again. After a few months of complaining back and forth, they agreed to give me a refund. They sent a link to UPS for postage free return. The link did not work. I complained and they sent another link that did not work. I spent about 3 hours on the phone to find out what the hell was going on. Got no results, so I withdrew from ebay after over 10 years and 228 purchases. The worst was that a few months after I cancelled my ebay account, they now want $38 for two shipments I supposedly made with their two bogus links to UPS. They can kiss my ***

I agree. Ebay is not a shadow of what it once was. Worse yet they don't have the buyer traffic any more. There are now hundreds of competing web sites offering similar items, often for less $. Even Amazon and IOffer are in the used motorcycle parts business (at least Amazon rides herd on its sellers so they're "clean").

This kind of seller deception via misleading descriptions (and incomplete ones) seems to be an epidemic on Ebay.
Examples: The one-size-fits-all bike parts offerings and cheap knock-offs from China like cheezy solo seats, hand grips, lights and turn signals (most are ABS plastic).

Ebay has said they are cracking down on this seller deception issue but they don't really enforce things until it gets overt and serious; witness the many action suits against them by software mfgs, electronics vendors, songwriters, artists, and luggage mfgs.

Their biggest competition is Craigslist with its easy / open access, no contracts, no fees and huge buyer traffic.

I'm only a few weeks away from canceling my Ebay account pending the outcome of this fraud matter. Like it or not I have to keep it open for records access.
