  • wreck by wrecker!!!

    wtf a gd wrecker pulled out in front of me tonight on the way to work!!! waited till i was right there and he didn't even hurry out of the way!

    i hit the brakes and slowed down but apparently because my gel grips were squeezed so tight i must have pulled it close to the throttle housing and wala instant vista cruise! well it all happened so fast as i went to release the clutch i never dreamed the throttle was stuck about half way so the bike ripped itself from my hands and did a small wheelie and exited the road stage left. leaving me soaring through the air along behind it!

    ****er waited till i got up and dusted myself off and then he took off like a bat out of hell! the bike looks mostly ok save the gas tank that f-ng piece of crap metal throttle sleeve make a nice huge dent in the top of my tank! i'v have always hated it and wanted to take it off and put something plastic on there guess ishould have! the bike landed in the grass so no major damage. my winter coat is ruined as is my old helmet.

    maybe i'll see him again oneday at the gas station it's about 2 miles from my house. if i see him i think i'll take it out on his mf wrecker! and then maybe his ass.

    Sorry about that happening, glad you and the bike are relatively ok. In situations like that, parts are easily replaced.

            Sounds like it is high time to file a complaint against that company for fleeing the scene of an accident. In KS its a felony, with a lengthy prison sentence, not sure about other places.

              Glad to hear you were able to "get up and dust yourself off"! It could have been a LOT worse.. Hopefully you got the name of the wrecker company, and you can call them on it! I don't know what the laws state if you don't actually come in contact with something, but he should be liable for SOMETHING!

                  That's what I'm not sure of... Is he still responsible, even if he didn't make contact with the vehicle?

                      At least in CA, if you cause an accident, even if you didn't make contact, then you are responsible. It's a little harder to prove that if contact was made, but it's still leaving the scene.

                        I just asked my sister, who is a CA cop, and her answer was that you are only required to stop and exchange information if you actually make contact with something/someone. In this case, it's considered a solo crash, and the wrecker driver is not legally responsible. Kinda sucks, but that's the law.

                          yeah i figured he drove off because he knew i'd kick his ass since he didn't actually hit me. plus it was a really old wrecker. maybe a late 70's early 80's truck and it was unmarked. otherwise he would be toast by now!

                            Its not about wether he actually made contact. There was an accident, he was there when it happened. In Nebraska it was called "failure to render aid" Not only that but he violated a right away, and his actions cause property damage, so that driver is liable. If thats truly the case, then I want to take a road trip to CA and see how many cars I can run off the road and get off scott free because I didnt make contact.

                              There is no law (in CA, anyway) that requires that you "render aid" to anyone, for any reason. You're on your own to protect and care for yourself. Of course, in this case, the wrecker driver stopped and made sure he stood up and dusted himself off, so that could be considered sufficient. In most cases, they will say that the person in the accident was at fault for "travelling at speeds unsafe for conditions" (which can mean anything over 0 mph if conditions are bad enough), or following too closely. If you try to run someone off the road, and they don't move, then you have to make the choice to hit them or not. If you hit them, you are at fault. If they swerve to miss you, and they hit something, THEY are at fault. This is because it is almost impossibe to prove, after the fact, that you made any action that would "force" them to swerve.
