    whoa

Whoa that sucks! Drug dealers are no fools to play around with. Crazy thing is most of them know more about the law than the cops. lol

I have a written bill of sale. I'm ok in that respect and that he has called the bike "your bike" in his messages.

He is also a pansy. I lived with the guy and if he had something to tell me, he would email it to me. "Hey man, you and that chick were loud last night. I couldn't sleep...etc..." He changed his number after I called him about the bike.

Even if I don't get it back, at least he'll get what's coming to him.

Funny thing...so I tell a coworker about what happened. He said, "take his car." lol Funny thing is that I work in a white collar software job, but this guy is an ex military South African with a hit on him back home for something he did with another guy's chick. lol We share great fight stories.

If you have a bill of sale on it with the VIN # on it, I would call the DMV and see if the contractor has tried to register it. He probably has a bill of sale from your "Buddy", and your buddy will have to prove he ownded it. If the contractor didn't get a bill of sale.. well.. either way the bike is yours. BUT... the big problem is getting the little worm to tell you who got it before you sue and have his sorry azz arrested for theft, fraud, transfer of stolen property, etc. Just throw the cards out there and tell him to pick which felony he'd like to have hanging around his neck the rest of his life.

Then...after this is all over... get a couple friends to swear you were with them all night, and go whip his sorry azz until your arms are tired! (OOPS.. did I just write that out loud??)

Do yourself an even bigger favor, get it titled in your name ASAP if you can. Of course that will be difficult if you bought it out of state as that would require an inspection in most states. A title would make it MUCH easier than playing the who has the better bill of sale game.

ALWAYS make sure and transfer title immediately for the several reasons shown in this thread and others.

I would...but I train MMA fighters. If I got caught...I'm in serious serious trouble. Plus it wouldn't be fun...like playing basketball against a 5 year old. Anybody seen the dodgeball scene from Billy Madison?

By the way, admitting you were actually there is half the battle for the cops sometime. When they use their, "We want to get your side of the story..." line...just deny knowing anything.

Titling it means nothing. He has a bil of sale, and the guy that stole it doesn't.

It's property, whether it is a vehicle or not. He could just as easily stole his couch. All Austin has to do is see if the PO will verify he sold it to him.

I would try and find out who has it now, and inform them that they are in possession of stolen property. They will likely return it quicker than the guy that stole it.

Well, All I know is that I looked at ALOT of bikes before I bought the Beast. And alot of them had no title. When I spoke ot my state BMV about this situation, they told me the bike belongs to whoever has the title in their book. Until I got them to sign over a good title, they would not register it to me. Bill of sale or no, no title, no registration.

Could his ex room mate not have given a bill of sale to the person he sold it to? Sure he could. Then which bill of sale is the right one? Who really owns it? This is where posession comes in. Title would make that discussion very short. JMHO.

This varies from state to state. In CA you can register a vehicle that has no title by doing a lien title. You post a bond for some value based on the value of the vehicle and you get a special title and registration. Additionally DMV will contact the owner of record if there is a record to determine if they did sell the vehicle. I had to deal with a couple of vehicles that way, and it takes some time, and a good bit of paperwork but it can be done, providing it doesn't come up in the computer as stolen (how I recovered my XS400 TWICE). Don't however have them find out that it was not in streetable condition when you got it though, or they WILL make you get a salvage title, which means a lot of paperwork, time and brake and light inspection (hard to find places that will do that for a bike around here too).

Cywelch, yes, Ohio seems to be one of the toughest states on this issue. We also require our titles to have the seller's signature notorized by a Notary Public or it is not valid. I found that in Indiana, it just needs to be signed by the owner. Never dealt with it in Kentucky.

Yeah in CA it doesn't even have to be signed. They tell you be very careful with it because whoever has the title owns the vehicle.
