    One other thing, they will try and 'write the bike off' as being too expensive to repair (ie; more than book value)

    However, you insured your running vehicle to have a running vehicle. You do not have to accept the write off. You can force them to either fix yours or replace it.

    If you have examples of bikes in the same shape, for far more than book value, you are ahead.

    A buddy got his '85 Shadow 1100 ran into a few years back and they wanted to give him $1200 for it. He laughed and told them he wanted it replaced with one in the same condition.

    HE found one that was close, they bought it, for $3200.

    Also, be VERY wary of them writing it off, then buying it back. In some places it is very hard to recertify a write-off.

            There is a classic cycle value guide in WALNECK'S CLASSIC CYCLE from time to time, also in the "STANDARD CATALOG OF JAPANESE MOTORCYCLES" BY DOUG MITCHEL" It's a cool 2 inch thick book of all the rice burners 59 to 07. They both set the top value for a 79 xs 11 sf at $5000 for a #1 show bike.

                    negligence states

                    I am so thankful that you are ok. "People Parts" are harder to find than "bike parts," especially since ebay can't carry "people parts!"

                    Anyway, I seem to remember that California went through a tort reform several years ago and went to either comparative negligence or, worse, to "no fault." If that is true, then it isn't going to matter who was at fault. Since this guy had just passed an official licensing, which I assume meant that he met the minimal qualifications for continued licensing, it should be interesting to hear what his defense would be, since he can't argue incompency when he had just argued his competency!

                    Thankfully, there is probably no way that there isn't a police report as it happened on a licensing agency property and they would have reported it for their own liability issues. I do disagree with any of the folks on the forum that suggest that you should change parts to make it look worse, BUT, it is a well known fact that accident victims frequently don't realize that they have sustained back injuries (or head, or hand or where ever) until the following day when the adrenaline has worn off and the soreness has set in. I would encourage you to go to a doctor with all the pain that you have became aware that you are suffering and I would go BEFORE I talked to an attorney. If you go AFTER talking to an attorney, there is the factual argument that the insurance can argue that "but for the attorney telling you to" you wouldn't have been injured. Juries are taking into consideration those kinds of things, ie, that the person didn't think he was injured until he talked to an attorney. Seems alittle, well, questionable to the average common person.

                    I bet your back hurts. . .and your neck. . .and your HAND. . .and your ELBOW from trying to cushion your fall when you had to dive to keep from being killed. . .
                    oh, and your shoulder from the impact. . .and, gosh, it really IS difficult to make love when you can't put any weight on your one side. . . and your wife has lost out on all those conjugal rights that she has. . . and lost your affection due to pain and suffering. . .and WORSE, it is impossible to work the remote control and hold a beer at the same time!

                      Very good advice, Cam

                      I have been very thankful for all of the input given here by everyone. Getting knocked off a bike by a cage is stressful and condusive to bad thinking. The suggestion by someone to change out parts was pretty much tounge-in -cheek, but funny nonetheless. We all think those thoughts. Admit it!!

                      I did go to the doc immediately the next day and I have not yet contacted an attorney. Researched a few on line though. Seems like there's plenty of 'em out there chasin' the PI claims. Must be money there, right?

                      Still have not heard from their adjuster (AAA). I don't carry physical damage on my bike but the adjuster for my ins. co, Progressive, was on the ball and seemed very knowledgebale about the bike. There is med pay on my policy, however, so I called them too. Perhaps I'll hear today. I called four times yesterday .... wouldn't take 'em days to get back if they were collecting ...........

                      The instructor from the DMV who had just passed this old turd who hit me is either very sweet or worried. She called me from a private line, presumably to ask a few questions about the accident. Mostly she seemed interested in how I was physically. I'm thinkin' that maybe the State is worried that this guy has just passed a drive test and only seconds later makes a total bonehead error nearly killing someone. We'll see, I guess.

                        When a lawyer files a suit here...
                        he might file against the driver, the vehicle manufacturer, the guy who sold him the cage, the designer of the brake and gas pedal, if he was wearing glasses the doctor who proscribed them plus the DMV examiner, the DMV supervisor who trained her and DMV too.

                        Years ago I had a customer try to sue me after he drove a machine I sold him over a foot high curb on a steep private road. It was in the system here for over three years, but he up and had a heart attack and died before it ever got resolved. Several companies/people were named in the suit who had nothing to do with his incompetence or the machine I sold him. Thru my lawyer I found I was not the first nor the second company he had sued but his heirs never got anything from me. They name everybody they can and some who have little or nothing to do with the case will pay something just to avoid having to go to court. In CA CA land you can be found to be a one percent “contributor” to an incident, but if you have money and the others don't can wind up paying ninety percent of the claim.

                          Be Hurt

                          Hi Wiz,, anyone calls, it would be advisable to claim that you don't feel good. Unfortunately my daughter had a bad accident and numerous people continuously called to check her "status" and her P.I. lawyer said to tell them all she was in bad shape and not getting better and to call her{the lawyer} for further statements. Any statement of feeling ok is used against the injured. The state examiner is worried about being sued, like Mr.O. said and also trying to pry info. from you. Maybe get a P.I. lawyer and direct all calls to that person. That would get the ball rolling, claims get done much faster. Most P.I. lawyers work on a percentage of winning amounts,,,,my daughters was 20 % and worth every penny. They also handle the hassle of contacting the insurers and other calls. She is Fully recovered and thanking the Lord every day for the recovery. Good luck, be careful, Mike

                            Yeh, I saw that too, I'm not sure why that is on the cover. No production numbers in it. I saw, in another book that only 250 mns were made a year, but I think that is crap too. I was told by a dealer that it was one for each dealer...between 2,000 and 2,500. I think the owners card for the 850 mns I had was 1,253 that would blow the 250 think out of the water. Yeh, Owner's card! I got it from the 1st owner's widdow. Did you know that they were hand made by teams of skilled workers that did the whole bike. Unlike my bike, I guess they used people off the street....It works just as good as a mns. They had better service, and were the bigggg deal at the time.You could even have your name put under the Yamaha on the front forks, if you got it from the factory. When I came accross a wrecked one at the junkyard it looked like a grave marker.
                            If the US gov't wouldn't have taxed them (Jap Bikes)so heavy they would have killed Harley in the early 80's. Instead, the gov't killed all the american owned Yamaha shops. Like the one that was accross the street from me, when I was little.... .

                                Got the estimate from ..

                                the shop today. $3461 .... whew ... that's about what I have in this bike ... yeah, yeah, I know. I've had a few issues with this one in the two years since I've owned it .... lol .... everything on it was junk ..... only thing good was the serial number ..... looked good though ..... put it all back together twice .... should be interesting from here on in though. I'm sure they're gonna' try to lowball me .... but thanks to the info. you all have given me in this thread, I'm much better prepared to deal with 'em. Already have one 'loss of use' check for about 500 bucks on the way. That's good, right? Keep your fingers crossed.
